Agreement to These Terms
(a) These Terms and Conditions (“Terms”) govern your access to and use of www.ridgereaders.com (the “Website”) and the DMIT (Dermatoglyphics Multiple Intelligence Test) assessment, DMIT report, Psychometric Assessment, Psychometric Report and other Reports based on findings from DMIT & Psychometric reports, and 1-on-1 interpretation/counselling services (the “Services”) offered by Ridge Readers (“we”, “us”, “our”).
(b) By booking an appointment, submitting a fingerprint scan, or otherwise accessing the Website or Services, you (“you”, the “Client”) or, where the Client is a minor or a legally dependent adult, the Client’s parent or legal guardian on the Client’s behalf agree to be bound by these Terms.
(c) These Terms should be read together with our Privacy Policy and our Consent Form, both of which govern how we collect, use, and protect your personal and biometric data. In the event of a conflict between these Terms and the Privacy Policy or Consent Form on a data-protection matter, the Privacy Policy and Consent Form shall prevail on that matter.
Eligibility and Parental/Guardian Consent
(a) Our Services are available to individuals of any age. Where the Client is under 18 years of age, or is a legally dependent adult, a parent or legal guardian must provide verifiable consent before the assessment begins and may exercise all rights and obligations under these Terms on the Client’s behalf.
(b) By booking or consenting on behalf of a minor or dependent, the parent or guardian confirms they have the legal authority to do so.
Nature of Our Services
(a) DMIT is a fingerprint-ridge-pattern analysis used to generate a report and provide general guidance on inborn talent, learning styles, strengths, and personality traits, delivered through a 1-on-1 interpretation session. A Psychometric Assessment is a questionnaire-based evaluation of cognitive abilities, behavioural traits and career interest.
(b) Not a Medical, Psychological, or Educational Certification: our Services do not constitute medical, psychiatric, psychological, or diagnostic advice, and are not a certified educational, career, or aptitude assessment recognised by any academic or regulatory body. If you have concerns about a child’s medical, developmental, or psychological wellbeing, please consult a qualified professional.
(c) No Guarantee of Outcomes: the DMIT report, Psychometric report and other related supporting reports based on findings from DMIT & Psychometric reports and interpretation session offer general guidance only. We do not guarantee any specific academic, career, or personal outcome, and decisions made in reliance on the report and session are the Client’s (or parent/guardian’s) own responsibility.
Booking, Fees, and Rescheduling
(a) Appointments may be booked through the Website, by phone, or by email, subject to availability.
(b) Fees for the assessment and interpretation session & modes of payment etc are as communicated to you at the time of booking. Cancellation or rescheduling requests should be made at least forty-eight (48) hours before the scheduled appointment. Cancellation at a short notice of less than twenty-four (24) hours before the scheduled appointment, may or may not guarantee refund of fees paid. Amount of refund will be at the discretion of Ridge Readers on case basis. Please note that notwithstanding the aforementioned cancellation policies, no refunds will be issued under any circumstances once fingerprints have been taken.
(c) We may, at our discretion, decline or reschedule an appointment, including where information provided is inaccurate or incomplete, or where we reasonably believe the assessment cannot be properly conducted.
Fingerprint Scanning and Biometric Data
(a) The assessment requires scanning all 10 fingerprints using a digital fingerprint scanner. You (or the parent/guardian, for a minor or dependent Client) must give explicit, informed consent via our Consent Form before any scan is taken.
(b) Fingerprint images are used solely to generate the DMIT report, are handled in accordance with our Privacy Policy as described in that Policy.
(c) You may withdraw consent to the use of your fingerprint data at any time by contacting us; however, this may mean we are unable to complete, or continue to provide, the Services, as described in our Privacy Policy.
The Report and Interpretation Session
(a) Following the fingerprint scan, we will generate a DMIT report and conduct a 1-on-1 session with the Client (or parent/guardian, if the Client is a minor) to explain the findings.
(b) The report(s) are provided for the Client’s personal, non-commercial reference only. You may not reproduce, publish, or redistribute the report, in whole or in part, for any commercial purpose without our prior written consent.
(c) We retain client details and the generated report for future reference, in accordance with our Privacy Policy and legal requirements, unless you request earlier deletion.
Confidentiality
(a) We do not share your personal or biometric data, your report(s), or the contents of your interpretation session with any third party, except where required by law or with your explicit consent.
(b) We expect the same discretion from you regarding any proprietary assessment methodology, software, or materials shared with you during the Services.
Client Responsibilities
(a) You agree to provide accurate and complete information when booking and during the assessment, and to notify us of any change to your contact details necessary for us to deliver the Services.
(b) You agree to cooperate reasonably with the fingerprint scanning process and interpretation session, including attending at the scheduled time.
Intellectual Property
(a) The DMIT assessment methodology, software, report format, and all related materials remain the intellectual property of Ridge Readers and/or its technology or licensing partners.
(b) We grant you a limited, non-exclusive, non-transferable licence to use your own report for personal reference only, subject to Clause 6(b).
Limitation of Liability
(a) To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Services shall not exceed the fees you paid for the specific assessment giving rise to the claim.
(b) We are not liable for any decision made, or outcome experienced, by you or the Client in reliance on the DMIT report, Psychometric report and/ or any other related supplementary reports based on the findings from DMIT & Psychometric reports or interpretation session, including academic, career, or personal decisions.
(c) Nothing in this Clause 10 limits any liability that cannot be excluded or limited under applicable law.
Data Protection
(a) We collect, use, and protect personal and biometric data in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDPA), and process such data only on the basis of the consent recorded in our Consent Form.
(b) For details on what we collect, why, how long we retain it, and your rights as a Data Principal (including access, correction, and erasure), please refer to our Privacy Policy.
Changes to These Terms
(a) We may update these Terms from time to time to reflect changes in our practices, services, or applicable law. The updated Terms will be posted on our Website.
(b) Continued use of our Website or Services after such changes take effect constitutes your acceptance of the updated Terms.
Governing Law and Dispute Resolution
(a) These Terms are governed by the laws of India. Subject to sub-clause (b), the courts at Bangalore, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
(b) Before initiating any formal proceeding, the Parties shall first attempt to resolve the dispute informally by writing to the other party and allowing a period of 30 days for discussion.
General
(a) Entire Agreement: these Terms, together with our Privacy Policy and Consent Form, constitute the entire agreement between you and Ridge Readers regarding the Services, and supersede any prior understanding on that subject.
(b) Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
(c) No Waiver: our failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision.
